1. Acceptance of Terms
These Terms of Service govern your use of www.fencedock.com and any quote, order, or purchase from FenceDock and Supply, LLC ("FenceDock & Supply", "we", "us"). By using this site or placing an order, you agree to these terms. If you do not agree, do not use the site.
2. Website Content
Product descriptions, dimensions, specifications, colors, and images are provided for reference. Manufacturing tolerances and screen color rendering vary. We reserve the right to correct errors and to change products and specifications without notice. Nothing on this site is an offer to sell; a binding sale is created only by a written quote accepted by both parties or by an order we confirm.
3. Quotes and Pricing
Quotes are valid for the period stated on the quote, and otherwise for 15 days. Pricing excludes applicable taxes, freight, and special handling unless expressly stated. Wholesale and tier pricing may require qualification as a contractor or dealer.
4. Orders and Payment
Orders are accepted subject to stock availability. Unless credit terms have been approved in writing, payment is due in full before shipment or pickup. Special-order, custom-color, and custom-height items require a deposit and are non-cancellable once production begins. Past-due balances may accrue interest at the maximum rate permitted by Texas law.
5. Delivery, Pickup, and Risk of Loss
Delivery dates are estimates and are not guaranteed. Unless otherwise agreed, title and risk of loss pass to the buyer upon pickup or upon delivery to the carrier. The buyer is responsible for providing safe, accessible unloading at the delivery site and for inspecting material at the time of receipt. Visible damage or shortages must be noted on the delivery receipt and reported to us within 48 hours.
6. Returns and Cancellations
Unused, undamaged stock items in original packaging may be returned within 30 days with prior written authorization and may be subject to a restocking fee. Custom, special-order, and cut-to-order items are non-returnable. Freight charges are non-refundable.
7. Warranty and Disclaimer
Products carry the applicable manufacturer's written limited warranty, which is provided with your quote or order. That warranty is the buyer's sole warranty. To the maximum extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Warranty coverage does not apply to improper installation, misuse, abuse, alteration, accident, vandalism, or acts of nature.
8. Limitation of Liability
To the maximum extent permitted by law, our total liability arising out of any order or use of this site is limited to the purchase price of the products giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, labor costs, or job-site delay costs.
9. Installation and Code Compliance
The buyer is solely responsible for site conditions, measurements, permits, HOA and municipal code compliance, utility locates, and installation workmanship. Published wind-load and performance ratings assume installation in accordance with manufacturer instructions.
10. Intellectual Property
All site content, including text, images, logos, and layout, is owned by FenceDock, LLC or its licensors and may not be copied or reused without written permission.
11. Governing Law
These terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Venue for any dispute lies in Harris County, Texas.
